TERMS AND CONDITIONS

By utilization of said services, Customer hereby agrees to the terms and conditions contained herein and as amended from time to time and posted to www.509fiber.com/terms.
Monthly Services
509Fiber bills Customer in advance and monthly for the specific services that Customer has subscribed to. Customer hereby agrees to pay for said services according to the terms and conditions contained herein.
Internet
509Fiber will provide paying Customer with internet service over the PUD fiber optic network. It is responsible for the continuous availability of data flow except when notified by email prior to an interruption or where the PUD has a service disruption. Customer must provide 509Fiber with a valid email address to use for this purpose. Customers may request an upgrade or downgrade in speeds as needed. This change will be applied on the next business day or on the date requested, as decided upon between Customer and 509Fiber.
Managed WiFi
Customer agrees to pay agreed-upon WiFi management fees to 509Fiber. In return, 509Fiber will ensure Customer has the best internet experience available, assist the Customer in troubleshooting should issues arise, and replace 509Fiber Managed Routers. The first router installation is fee, additional routers desired to be added to the home to expand the mesh network cost a $60 installation fee per additional router installed. Any equipment provided by 509Fiber remains the property of 509Fiber. Customers are responsible for maintaining the equipment in good condition and returning it upon service termination. In the event of issues that are deemed to be the responsibility of Customer (for example, Customer resets router configuration), 509Fiber reserves the right to charge for a Service Call at the higher of $75 per in-home call or $75 per hour. Customers agree to provide 509Fiber technicians with reasonable access to perform necessary maintenance or repairs.
Non-Managed WiFi Plans
In the event you purchase hardware outright through 509Fiber, it is not warranted by 509Fiber. You may wish to contact the manufacturer directly for any warranty. 509Fiber reserves the right to charge for any type of service call, whether it is for troubleshooting, hardware replacement, or otherwise. 509Fiber reserves the right to charge for a Service Call at the higher of $75 per in-home call or $75 per hour. Customers agree to provide 509Fiber technicians with reasonable access to perform necessary maintenance or repairs.
Television Plans
Just ask Jimmy
Customer agrees to allow Just Ask Jimmy and its representatives to manage agreed-upon services on Customer’s behalf to negotiate and make financial and contractual decisions on the respective accounts in the form of a Power of Attorney. This negotiating service does not include technical support beyond basic troubleshooting of services or equipment provided by 509Fiber.
Streaming Management
Service Description
509Fiber does not represent any specific streaming service, rather, it provides management services for various streaming accounts as part of selected plans or as standalone offerings. 509Fiber is committed to identifying the best service plan that will work for your interests and needs. The availability of specific content, channels, or features is subject to change and may depend on agreements that content providers possess.
Supported Devices
Customers are responsible for ensuring their devices meet the minimum requirements for accessing streaming services. 509Fiber does not guarantee compatibility with all devices or operating systems.
Bandwidth Usage
Streaming services may consume significant amounts of data. Customers are responsible for any data usage charges that may apply to their internet service plan. 509Fiber reserves the right to implement reasonable network management practices to ensure fair usage for all customers.
Account Sharing and Security
Customers agree not to share their streaming service login credentials outside their household. 509Fiber may limit the number of simultaneous streams per account to prevent unauthorized usage.
Content Restrictions
Customers agree not to reproduce, distribute, or publicly display any content accessed through the streaming services. Use of VPNs or other location-masking technologies to access geo-restricted content is prohibited.
Troubleshooting and Support
509Fiber will provide initial troubleshooting support for streaming services over the phone at no additional charge. If phone-based troubleshooting is unsuccessful and an in-person service call is required, standard service call fees will apply. Customers will be informed of potential charges before any in-person service call is scheduled.
Service Interruptions
509Fiber does not guarantee uninterrupted access to streaming services and is not responsible for service interruptions caused by third-party content providers or internet issues outside our network.
Cancellation and Refunds
Cancellation policies for streaming services may vary depending on the specific service and plan. Advise 509Fiber of your cancellation plans for more information.
Cell Phone and Landline Plans
Any equipment provided by 509Fiber remains the property of 509Fiber. Customers are responsible for maintaining the equipment in good condition and returning it upon service termination.
Cell Phone Service Terms
Plan Details
Customers agree to the specific terms of their chosen cell phone plan, including data limits, call minutes, and text message allowances. Exceeding plan limits may result in additional charges or reduced data speeds.
Device Policies
Customers may purchase devices from 509Fiber or use compatible unlocked devices. Device payment plans, if applicable, are subject to credit approval and additional terms.
Number Porting
509Fiber will assist with porting numbers from other carriers, subject to availability and technical limitations. Customers are responsible for any fees associated with breaking contracts with previous carriers.
International Usage
International calls, texts, and data usage may incur additional charges unless specified in the plan. Customers are advised to review international rates before using services abroad.
Mobile Data
509Fiber reserves the right to optimize and manage network resources to ensure fair usage for all customers. Unlimited data plans may be subject to reduced speeds after a certain threshold of usage.
Landline Service Terms
Service Reliability
While 509Fiber strives for maximum uptime, we do not guarantee uninterrupted landline service. Customers acknowledge that landline service may be affected by power outages or network issues.
Emergency Services
Customers are informed that 911 or other emergency services may operate differently compared to traditional landline services. Customers agree to inform all potential users of the landline about any limitations in emergency service access.
Features and Add-ons
Additional features such as voicemail, call waiting, or caller ID may incur extra charges. Customers agree to the terms and pricing of any add-on features selected for their landline service.
Number Assignment
509Fiber will assign a phone number to the customer's landline service. Customers may request a specific number, subject to availability and possible additional fees.
Fair Usage
Landline services are intended for reasonable personal or business use. 509Fiber reserves the right to disconnect or modify service for customers whose usage is excessive or unreasonable.
Changes to Cell Phone and Landline Services
509Fiber may modify, update, or discontinue any cell phone or landline plan or feature with appropriate notice to customers. Customers will be notified of any changes that may affect their service or billing.
Payment
All monthly invoices for services provided or to be provided are due upon receipt. Payments may be made by automatic draft or automatic payment with a credit or debit card. Any other form of payment must be preapproved by 509fiber.
Pay by Check
Customers who wish to pay by check must agree to a quarterly payment plan. This quarterly payment plan is prorated. Customers can choose to pay quarterly, semiannually, or annually. This must be approved by 509Fiber in advance to beginning the billing schedule.
Late Payment Charge
Invoices that remain unpaid for more than seven days following the invoice date will be considered delinquent and may be subject to a late payment charge. A late payment charge may be assessed on accounts in which a payment has not been received within 7 days of the due date. At this point, service will be deactivated and a $20 reactivation fee will be applied.
Failure to Pay
Failure to pay for services received will result in suspension of services. Accounts may be at risk of suspension once the account becomes more than 7-days past due. A notice of Account Past Due will be sent via email, phone call, and/or SMS depending on which contacts the customer has on file.
Reactivation Requirements
In order to reactivate the account, the suspended customer will need to pay all past due balances. Reactivation fees of $20 will be charged to the account at the time payment is made.
Service Termination
In order to terminate services, Customer must notify 509Fiber. Services will be terminated on the next business day or on the arranged date, whichever is later.
Limitation of Liability
509Fiber is not liable for service interruptions beyond our control or for any consequential damages.
Privacy and Data Protection
509Fiber commits to protecting customer privacy and handling personal data in accordance with applicable laws. Customers agree to 509Fiber's Privacy Policy, which is available on our website.
Acceptable Use Policy
Customers agree to abide by 509Fiber's Acceptable Use Policy, which prohibits illegal activities, spam, and network abuse.
Changes to This Agreement
509Fiber reserves the right to modify these Terms of Service and pricing at any time. We do so by posting and drawing attention to the updated terms on the website www.509fiber.com/terms. You agree to accept these changes. Should you not agree to any provision of this Agreement or any changes we make to this Agreement, we ask that you advise us immediately.

Al utilizar dichos servicios, el Cliente acepta los términos y condiciones contenidos en este documento y sus modificaciones periódicas y publicadas en www.509fiber.com/terms.
Servicios Mensuales
509Fiber factura al Cliente por adelantado y mensualmente por los servicios específicos a los que el Cliente se ha suscrito. Por el presente, el Cliente acepta pagar dichos servicios de acuerdo con los términos y condiciones aquí contenidos.
Internet
509Fiber proporcionará al Cliente que paga servicio de Internet a través de la red de fibra óptica PUD. Es responsable de la disponibilidad continua del flujo de datos, excepto cuando se notifique por correo electrónico antes de una interrupción o cuando el PUD tenga una interrupción del servicio. El cliente debe proporcionar a 509Fiber una dirección de correo electrónico válida para utilizarla con este fin. Las velocidades de Internet estarán a la altura de la tarifa prescrita y se garantiza que serán más rápidas que las del nivel inferior.
Servicios gestionados
El cliente acepta pagar las tarifas de gestión acordadas a 509Fiber. A cambio, 509Fiber se asegurará de que el Cliente tenga las mejores tarifas disponibles y lo ayudará en la resolución de problemas básicos en caso de que surjan problemas. En caso de problemas que se consideren responsabilidad del Cliente, 509Fiber se reserva el derecho de cobrar por una Llamada de Servicio a un monto mayor de $75 por llamada a domicilio o $75 por hora. En caso de que compre hardware directamente a través de 509Fiber, 509Fiber no lo garantiza. Es posible que desee ponerse en contacto con el fabricante directamente para cualquier garantía.

El Cliente acepta permitir que Just Ask Jimmy y sus representantes administren los servicios acordados en nombre del Cliente para negociar y tomar decisiones financieras y contractuales sobre las respectivas cuentas en forma de un poder notarial. Este servicio de negociación no incluye soporte técnico más allá de la resolución de problemas básicos de los servicios o equipos proporcionados por 509Fiber.
Pago
Todas las facturas mensuales por los servicios prestados o por prestarse vencen al recibirse. Los pagos podrán realizarse mediante giro automático o pago automático con tarjeta de crédito o débito. Cualquier otra forma de pago debe ser aprobada previamente por 509fiber.
Cargo por pago atrasado
Las facturas que permanezcan impagas durante más de siete días después de la fecha de la factura se considerarán morosas y pueden estar sujetas a un cargo por pago atrasado. Se puede aplicar un cargo por pago atrasado a las cuentas en las que no se haya recibido un pago dentro de los 7 días posteriores a la fecha de vencimiento. En este punto, el servicio se desactivará y se aplicará una tarifa de reactivación de $20.
Fondos insuficientes
Los pagos fallidos por fondos insuficientes activarán una notificación inmediata al cliente y 509Fiber se reserva el derecho de cobrar una tarifa de servicio de $15.00. Los pagos automáticos con tarjeta de crédito o débito que sean rechazados también activarán una notificación inmediata al cliente, y 509Fiber se reserva el derecho de cobrar una tarifa de servicio de $15.00.
Falta de pago
La falta de pago de los servicios recibidos resultará en la suspensión de los servicios. Las cuentas pueden correr el riesgo de ser suspendidas una vez que tengan un atraso de más de 7 días. Se enviará un aviso de cuenta vencida por correo electrónico, llamada telefónica y/o SMS, según los contactos que el cliente tenga registrados.
Requisitos de reactivación
Para reactivar la cuenta, el cliente suspendido deberá pagar todos los saldos vencidos. Se cargarán tarifas de reactivación de $20 a la cuenta en el momento en que se realice el pago.
Terminación del servicio
Para cancelar los servicios, el Cliente debe notificar a 509Fiber. Los servicios finalizarán el siguiente día hábil o en la fecha acordada, lo que ocurra más tarde.
Cambios a este acuerdo
509Fiber se reserva el derecho de modificar estos Términos de servicio y precios en cualquier momento. Lo hacemos publicando y llamando la atención sobre los términos actualizados en el sitio web www.509fiber.com/terms. Usted acepta aceptar estos cambios. Si no está de acuerdo con alguna disposición de este Acuerdo o cualquier cambio que realicemos en este Acuerdo, le pedimos que nos informe de inmediato.
